BananaSplit Terms of Service

1. Eligibility

You may use the Services only if:

If you use the Services on behalf of a business or other organization, you confirm that you have authority to agree to these Terms for that organization.

• you are at least 18 years old, or the age of legal majority where you live;
• you have the legal capacity to enter into a binding agreement; and
• your use of the Services does not violate any applicable law or regulation.

2. What BananaSplit Does

BananaSplit helps users track shared expenses, create groups, invite friends, record payments, upload receipts, screenshots, or profile images, tag stories with optional places, and manage balances between participants.

BananaSplit is a tool for tracking and coordinating shared expenses. Unless we explicitly say otherwise, BananaSplit is not a bank, money transmitter, payment processor, financial advisor, debt collector, or escrow service. We do not independently verify that the expense, split, or payment information entered by users is accurate.

3. Your Account

You are responsible for:

You may not share your account credentials with others or impersonate another person or entity.

• providing accurate and complete registration information;
• maintaining the confidentiality of your login credentials;
• all activity that occurs under your account; and
• notifying us promptly if you believe your account has been accessed without authorization.

4. User Content and Data

You may submit content through the Services, including account details, names, expense descriptions, receipts, screenshots, profile images, place tags, comments, balances, and other information ("User Content").

You keep ownership of your User Content. You give BananaSplit a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, and display that content only as needed to operate, improve, secure, and provide the Services.

You represent and warrant that:

• you own or have the rights needed to submit the User Content;
• your User Content does not violate any law or infringe any third-party rights; and
• your User Content is not fraudulent, misleading, defamatory, or abusive.

5. Acceptable Use

You agree not to:

We may investigate violations of these Terms and suspend or terminate accounts when necessary.

• use the Services for any unlawful, fraudulent, or deceptive purpose;
• upload malware, malicious code, or harmful content;
• interfere with the integrity or performance of the Services;
• attempt to gain unauthorized access to accounts, systems, or data;
• reverse engineer, copy, scrape, or exploit the Services except as permitted by law;
• use the Services to harass, threaten, or harm others; or
• submit false expenses, false payment records, or misleading identity information.

6. Invites, Shared Groups, and Collaboration

The Services allow you to invite others into shared expense groups and collaborate on shared records. By using these features, you understand that:

You are responsible for ensuring that the expense and payment information you enter is accurate and appropriate to share.

• information you add to a shared group may be visible to other members of that group;
• group members may rely on the information you enter when tracking balances or payments; and
• disagreements about whether a payment was made or an expense is valid are between the relevant users, not BananaSplit.

7. Receipts, Photos, and Other Uploads

If you upload receipts, screenshots, profile images, or similar files, you are responsible for what those files contain. Avoid uploading sensitive personal information unless it is necessary for your use of the Services.

Receipt and screenshot uploads may be sent to our backend and AI/OCR processors to extract expense details.

We may set reasonable technical limits on file size, file type, retention, or storage usage.

8. Notifications and Communications

You agree that we may send service-related communications, including verification messages, security notices, account updates, expense alerts, reminders, and product updates.

When you create an account or subscribe to the newsletter, we may send you BananaSplit product updates, launch notes, and marketing emails. We use Loops to process and deliver newsletter emails.

You can unsubscribe from marketing emails at any time using the unsubscribe link in the email or any other method we provide. Where required by law, we will obtain consent before sending marketing communications.

9. Third-Party Services

The Services may include links to or integrations with third-party services, including app stores, analytics providers, support tools, or external websites. We do not control those third-party services and are not responsible for their content, actions, or terms.

Your use of third-party services is governed by those third parties' terms and policies.

Banana Gold subscriptions

Some features of the Services are offered through Banana Gold, an auto-renewing paid subscription. Banana Gold may include monthly and yearly billing options, currently shown in the app as EUR 1.99 per month or EUR 19.99 per year, or the equivalent price in other currencies where available.

Pricing, available plans, included features, usage caps, taxes, and renewal terms may vary by platform, region, promotions, currency, and future price changes. The price and terms shown to you at checkout or in the applicable store or billing flow control for your purchase.

If you subscribe on iOS or Android, billing, renewals, cancellation, and related subscription management are handled through the Apple App Store or Google Play, subject to their terms. If you subscribe on web, billing and subscription management are handled through RevenueCat Web Billing and RevenueCat's customer portal flows.

Your subscription renews automatically unless you cancel before the next renewal date through the applicable store settings or billing management portal. You may also use supported restore purchase flows to reconnect eligible purchases to your account.

• Banana Gold feature access depends on your subscription remaining active;
• free and paid plans may include different feature limits, quotas, and recurring expense allowances as displayed in the Services;
• on web, some plan changes, including moving from monthly to yearly billing, may be handled through the provider's management flow instead of a separate new purchase; and
• we may change, suspend, or discontinue subscription offerings, pricing, or included features at any time, subject to applicable law.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge that we may process personal information as described there.

11. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Services at any time, to the extent permitted by law.

We cannot guarantee that the Services will always be uninterrupted, secure, error-free, or continuously available.

12. Termination

You may stop using the Services at any time.

We may suspend or terminate your access to the Services if:

If your access ends, your right to use the Services ends as well. Sections that are meant to continue after termination will still apply, including ownership, disclaimers, limitations of liability, dispute provisions, and indemnity.

• you violate these Terms;
• we reasonably believe your use creates risk for other users, BananaSplit, or third parties; or
• we are required to do so by law.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available." BananaSplit disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that:

• expense calculations, balances, reminders, or records will always be accurate;
• users will honor payments or obligations recorded in the Services;
• the Services will meet your requirements; or
• the Services will be uninterrupted, timely, secure, or error-free.

14. Limitation of Liability

To the maximum extent permitted by law, BananaSplit and its directors, officers, employees, contractors, affiliates, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to the Services or these Terms.

To the maximum extent permitted by law, BananaSplit's total liability for all claims arising out of or related to the Services or these Terms will not exceed the greater of:

• the amount you paid us, if any, for use of the Services during the 12 months before the event giving rise to the claim; or

15. Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless BananaSplit and its affiliates, officers, directors, employees, contractors, and licensors from and against claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or related to:

• your use of the Services;
• your User Content;
• your violation of these Terms; or
• your violation of any law or third-party rights.

16. Governing Law and Disputes

These Terms will be interpreted in accordance with applicable law.

If a dispute, claim, or controversy arises out of or relates to these Terms or the Services, you agree to contact BananaSplit first so we can try to resolve it informally.

If we cannot resolve the issue informally, the dispute will be handled in the forum determined by applicable law, unless both sides agree to use a different resolution method.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may let you know by posting the updated Terms, updating the "Last updated" date, or using another reasonable method.

Your continued use of the Services after the updated Terms become effective means you accept the revised Terms.

19. Miscellaneous

• If any part of these Terms is found unenforceable, the rest will remain in effect.

• You may not assign or transfer these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.
• These Terms, together with any policies or supplemental terms expressly incorporated by reference, form the entire agreement between you and BananaSplit regarding the Services.
